General terms and conditions
1. General
These General Terms and Conditions are an integral part of the contract between you (hereinafter referred to as the guest) and easyAlps Beherbergungs GmbH, 3818 Grindelwald (hereinafter referred to as easyAlps).
2. Conclusion of contract
Bookings can be made via website, external booking platforms, by email or verbally. With the reservation confirmation from easyAlps, a contract for the accommodation is considered valid. The general terms and conditions and the booking confirmation sent by easyAlps by e-mail or via the booking platform are part of this contract. The rights and obligations arising from these general terms and conditions are effective for both parties. The information contained in the booking confirmation is binding.
3. Prices / Minimum rental period
The prices published on the easyAlps websites or on the respective booking channel used (e.g. Booking.com, AirBnB, e-domizil etc.) apply. With the booking, this price is accepted by the guest. We reserve the right to adjust prices in the event of obviously and erroneously incorrectly published prices. The guest must be informed of such a price adjustment within 48 hours of receipt of the booking. After this notification, the guest may withdraw from the contract within 24 hours without incurring any costs. Further claims of the guest remain excluded. We reserve the right to adjust prices in the event of newly introduced or increased government levies (VAT, visitor's tax, etc.). The same applies to the publication of the minimum rental period of an object.
4. Payments
If the total amount is not paid directly at the time of booking, the total amount must be paid no later than 14 days for holiday apartments/houses and no later than 7 days for individual rooms before the start of the rental period. For short-term bookings (bookings arriving after the above-mentioned deadlines), the total amount must be paid within 3 days of receipt of the booking confirmation. For bookings made at even shorter notice of less than 3 days before the start of the rental period, the total amount must in any case be paid before arrival. If the total amount is not paid on time, easyAlps has the right to refuse to hand over the rental property.
5. Cancellation conditions
Cancellations must be sent to easyAlps in writing. For bookings via external platforms, the cancellation conditions apply according to the information on the respective platform. For all other bookings, the following conditions apply:
Holiday apartments and houses
- Confirmed bookings can be cancelled free of charge up to 14 days before arrival.
- In the period from 14 days before the start of the rental period until the start of the rental period, 100% of the accommodation costs will be charged. Cleaning fees and visitor's tax will not be charged.
Single room
- Confirmed bookings can be cancelled free of charge up to 7 days before arrival.
- In the period from 7 days before the start of the rental to 3 days before the start of the rental, 50% of the total costs will be charged.
- In the period from 3 days before the start of the rental until the start of the rental, 100% of the total costs will be charged. Any overpaid fees will be refunded in the same way as they were paid. (External payment fees may apply) The same rules apply to rebookings.
6. Arrival and departure
The arrival of the guest is completely independent. easyAlps informs the guest of the exact address of the property. The guest is given the option of independently locking and unlocking the accommodation using a numerical code. Unless otherwise stated in writing, arrival on the day of arrival is possible from 4 p.m. and departure on the day of departure is mandatory by 10 a.m. at the latest. If the accommodation is left later than agreed, a fee of CHF 100.- per commenced hour will be charged. If you arrive later than 10.00 p.m. and depart before 7.00 a.m., the rest period according to point 7 must be observed. If a parking space is offered to the guest (paid or free of charge), easyAlps only assumes liability to the extent required by law.
- Duties and liability of the guest
The rental property may only be occupied by the number of persons stated in the reservation confirmation (children and infants included). In the event of overcrowding, easyAlps has the right to refuse to hand over the property or to charge up to CHF 30 per person per night. The rented property must be used with care. Neighbours must be taken into consideration. A general quiet period applies from 10 p.m. to 7 a.m., i.e. excessive noise and the playing of music is prohibited.
The guest is responsible for everything that belongs to the rental property. The guest is obliged to immediately report all defects and damages that occur during the rental period. On departure, the object must be handed over by the guest with all accessories in the same condition as it was found on arrival. Cleaning of crockery and cutlery is the responsibility of the guest and is not included in the final cleaning.
He/she shall be liable for any damage caused by him/her and his/her companion, whereby the guest shall be responsible for proving that he/she is not at fault. The same applies if the accommodation cannot be handed over to the next tenants.
8. Cleaning
The rental property will be cleaned by easyAlps at the end of the stay. Excessive and unusual soiling caused by the guest may be charged to the guest. Intermediate cleaning during the stay is not included. At the guest's request, intermediate cleaning can be carried out for an appropriate fee. Advance notice the day before is mandatory.
9. Unreasonableness of the performance of the contract by easyAlps
easyAlps has the right to cancel the contract in the event of unforeseeable or avoidable circumstances before or after arrival. These include circumstances that endanger the guest or the accommodation or if the provision of services is so severely impaired that the execution of the contract is no longer reasonable. easyAlps is not liable for damages in any of these cases. In the event of force majeure such as political unrest, strikes, disasters, etc., easyAlps may also cancel the tour for safety reasons. In such cases, the guest will be refunded any overpaid fees in the form of a voucher.
10. Complaints
easyAlps must be informed immediately if the accommodation is not in the condition agreed in the contract. The same applies to any damage suffered. If the complaint is not reported immediately upon arrival, easyAlps assumes that the property has no defects. Claims on the part of the guest must be notified to easyAlps in writing within 2 weeks of departure with appropriate evidence. If this is not complied with, the guest loses all rights to compensation.
11. Data protection
easyAlps may process and use the data recorded as part of the conclusion of the contract to fulfil the obligations arising from the contract. The company shall take the measures required to secure the data in accordance with the statutory provisions. The Guest fully agrees to the storage and contractual use of his/her data by the Company and is aware that the Company is obliged and entitled to disclose information from the Guest to courts or authorities or to third parties if ordered to do so. If the guest has not expressly prohibited it, easyAlps may use the data for marketing purposes. The data necessary for the performance of the service may also be passed on to commissioned service partners. All access locks keep an access log which records which user opened the lock and when. Recorded surveillance footage will be kept as legally advised.
12. Provided Wi-Fi
The use of the available W-Lan network in the property is free of charge. By using the network, the guest automatically accepts the separate supplementary agreement to the rental contract for furnished accommodation for private use concerning the use of the Wi-Fi. www.elements-lodge.ch/en/info/wlan(https://www.elements-lodge.ch/en/info/wlan)
13. Liability
Liability for any indirect damage and consequential damage is excluded in full. Liability for direct damage is limited to the rental price. This limitation of liability does not apply to direct damage caused by gross negligence or intent. The client is obliged to report any damage to the company immediately. Any liability for auxiliary persons is excluded in its entirety.
14. Severability clause
Should a provision of this contract or an annex thereto be or become invalid, this shall not affect the validity of the remainder of the contract. The contracting parties shall replace the invalid provision by a valid provision which comes as close as possible to the intended economic purpose of the invalid provision. The same shall apply to any loopholes in the contract.
15. Applicable law / place of jurisdiction
In the case of translated versions of these General Terms and Conditions, the German version shall always prevail in the event of a dispute. These GTC are subject to Swiss law. Insofar as no mandatory legal provisions take precedence, the court in Interlaken shall have jurisdiction. easyAlps is free to bring an action at the defendant's place of business.
